TERMS AND CONDITIONS OF SALE

These terms of sale are concluded on one hand by the company MERLIN SKATEBOARDS, located at 3 rue André Maurois 24100 BERGERAC, registered in the Bergerac Trade and Companies Register under number 91047057400039, hereinafter referred to as "MERLIN SKATEBOARDS" and managing the website https://www.merlinskateboards.com/, and on the other hand by any individual or legal entity wishing to make a purchase via the website https://www.merlinskateboards.com/, hereinafter referred to as "the buyer."

Article 1. Purpose

These terms of sale are intended to define the contractual relationship between MERLIN SKATEBOARDS and the buyer and the conditions applicable to any purchase made through the website https://www.merlinskateboards.com/. The acquisition of a product through this website implies an unreserved acceptance by the buyer of these terms of sale, of which the buyer acknowledges having been made aware prior to placing an order. Before any transaction, the buyer declares that the purchase of products on the website https://www.merlinskateboards.com/ is unrelated to their professional activity and is limited to strictly personal use, and also declares having full legal capacity to commit to these general terms of sale.
MERLIN SKATEBOARDS reserves the right to modify these terms of sale at any time in order to comply with new regulations or to improve the use of its website. Therefore, the conditions applicable will be those in effect on the date of the buyer's order.

Article 2. Products

The products offered are those listed on the website https://www.merlinskateboards.com/ of MERLIN SKATEBOARDS, within the limits of available stock. MERLIN SKATEBOARDS reserves the right to modify the product assortment at any time. Each product is presented on the website with a description of its main technical characteristics (dimensions, composition, equipment...). The photographs are as accurate as possible but are not binding on the Seller.

Article 3. Pricing

Prices listed on the product pages of the online catalog are in Euros (€), inclusive of all taxes (VAT included), taking into account the applicable VAT on the day of the order. Any change in the VAT rate may be reflected in the price of the products. MERLIN SKATEBOARDS reserves the right to modify its prices at any time, but it is understood that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, which are charged in addition to the price of the products purchased depending on the total amount of the order.

Article 4. Orders and Payment Methods
​
For any order, the buyer may make a direct payment on the website https://www.merlinskateboards.com/ without creating an account. In this case, they will be informed of their order details and progress via email. They may also create an account on the website https://www.merlinskateboards.com/. The account creation section is directly accessible from the side menu. With each visit, the buyer, if they wish to place an order or consult their account (order status, profile...), must log in using their account information. MERLIN SKATEBOARDS offers the buyer the option to order and pay for their products in several steps, with 3 payment options:
- Payment by credit/debit card : The buyer selects the products they wish to order in the "cart," modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Shipping costs are then calculated and presented to the buyer, along with the carrier's name. The buyer then chooses their preferred payment method: "Payment by credit/debit card." Finally, the last step allows the buyer to review all information, acknowledge and accept the general terms of sale by checking the corresponding box, and then validate their order by clicking the "Confirm my order" button. This final click constitutes the definitive conclusion of the contract. Upon validation, the buyer receives an order confirmation email.
- Payment by bank transfer : The buyer follows the same steps as above, then selects "Payment by bank transfer." Upon validating the order, the buyer receives an order confirmation and must then contact their bank to transfer the payment to the MERLIN SKATEBOARDS account. Once the payment is received, the order will be processed.
- Secure payment via PayPal or credit card : After selecting "Payment by PayPal," the buyer is redirected to PayPal's secure interface to securely enter their PayPal account or credit card details. If the payment is accepted, the order is recorded.

Article 5. Retention of Title
​
MERLIN SKATEBOARDS retains full ownership of the sold products until full payment is received, including all applicable charges and taxes.

Article 6. Withdrawal
​
Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and return the product to the seller for an exchange or refund without penalty, excluding return shipping costs.
Article 7. Delivery
​
Deliveries are made to the address specified on the order form, within the agreed geographic area. MERLIN SKATEBOARDS uses multiple carriers to ship orders, including La Poste via the COLISSIMO tracked service, as well as pickup point delivery options for added flexibility. Delivery times are provided as estimates; if these times exceed thirty days after the order date, the sales contract may be terminated, and the buyer will be refunded. MERLIN SKATEBOARDS can provide the buyer with a tracking number for their package via email.

Delivery can be made either directly to the buyer’s home or to a pickup point if this option is selected. In the case of absence during home delivery, the buyer will receive a delivery notice, allowing them to collect the ordered products at the nearest pickup location or post office, as instructed by the carrier. The risks associated with transport are transferred to the buyer once the items leave MERLIN SKATEBOARDS’ premises. The buyer is required to check the packaging and contents of the goods in the presence of the delivery person or representative. In case of damage during transit, any claim must be made to the carrier within three days following delivery.

Article 8. Warranty
​
All products supplied by MERLIN SKATEBOARDS are covered by the legal warranty as per Articles 1641 and following of the Civil Code. In case of non-conformity, the product may be returned for exchange or refund.

Article 9. Liability
​
MERLIN SKATEBOARDS is only bound by a best-effort obligation in distance selling. Its liability cannot be held for damages resulting from internet use, such as data loss, intrusion, virus, service interruption, or other unintentional issues.

Article 10. Intellectual Property
​
All elements of the website https://www.merlinskateboards.com/ remain the intellectual and exclusive property of MERLIN SKATEBOARDS.

Article 11. Personal Data
​
MERLIN SKATEBOARDS commits to maintaining the confidentiality of the information provided by the buyer. Any information concerning the buyer is subject to the provisions of Law No. 78-17 of January 6, 1978.
Article 12. Dispute Resolution

These terms of sale are subject to French law. In case of dispute, jurisdiction is assigned to the competent courts of Bergerac.
